§1 Applicability to Entrepreneurs and Definitions
(1) These General Terms and Conditions apply to all deliveries between Dion Consulting GmbH and consumers in their version valid at the time of the order.
Consumer means any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity (§ 13 BGB).
§2 Conclusion of Contract, Storage of Contract Text
(1) The following regulations regarding the conclusion of a contract apply to orders via our online shop http://www.magneto-watch.com.

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer on our part but is only an invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer makes a binding contract offer by successfully completing the order process in our online shop.
The order is placed in the following steps:
Selection of the desired goods
Confirmation by clicking the "Add to Cart" button
Review of information in the shopping cart
Clicking the "Proceed to Checkout" button
Confirmation of the "Proceed to Free Shipping" button
Selection of shipping options
Confirmation of the "Securely Pay" button
Selection of payment methods and billing address
Confirmation of the "Review Order" button
Review of the provided data (contact information, delivery address, payment method, billing address)
Binding submission of the order by clicking the "Place Order" or "Buy" button
Before the binding submission of the order, the consumer can use the "Back" button in the internet browser to return to the webpage where the customer's information is recorded and correct input errors. We confirm the receipt of the order immediately by an automatically generated email ("Order Confirmation"). With this, we accept your offer.
At Magneto Watch, we value a smooth ordering process. Once your order is received, we work to ship it as quickly as possible. However, we kindly ask our valued customers to pay special attention to the accuracy of the information. This includes personalized engraving texts intended for the watch. Please review this information carefully, as we cannot edit it after the order has been submitted. The same applies to delivery addresses. We kindly request you to provide your correct delivery address. Please use the designated fields and enter the correct information in the appropriately labeled fields.
(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our terms and conditions by email. You can also view the terms and conditions at any time at https://magneto-watch.com/policies/terms-of-service by clicking on the link in the order confirmation email "View Order".
§3 Prices, Shipping Costs, Payment, Due Date
(1) The prices indicated include the statutory value-added tax and other price components. Additional shipping costs may apply.
(2) The consumer has the option of payment via PayPal, credit card (Visa, Mastercard, American Express).
(3) The use of our website magneto-watch.com is intended only for natural and legal persons who can enter into legally binding contracts and intend to purchase the products for their own use or as a gift.
(4) Magneto Watch delivers worldwide. The recipient specified in the delivery address also becomes the importer of the purchased product and must comply with the laws and regulations of the destination country. The purchased goods are subject to import VAT, customs duties, and fees imposed by the destination country.
The recipient designated in the delivery address may be subject to import VAT and customs duties and may incur fees once the delivery reaches the destination country. If additional costs for customs clearance or import VAT arise, these additional costs are borne by the buyer. We have no influence on these costs and cannot predict their amount. If a customs clearance procedure is necessary, this may lead to delays in delivery, and the originally indicated delivery times by MAGNETO cannot be adhered to.
§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch.
Delivery takes place no later than:
Within Germany within 5 working days.
Within the EU area within 8 working days.
To the USA within 14 working days.
In countries that do not belong to the USA or the EU area, the shipping time may increase to up to 21 working days.
In this case, the deadline for delivery begins on the day after the payment order is issued to the bank responsible for the transfer in the case of payment in advance, and in the case of all other payment methods, on the day after the contract is concluded. If the deadline ends on a Saturday, Sunday, or public holiday at the place of delivery, the deadline ends on the next working day.
(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer in the case of a mail-order purchase only when the item is handed over to the buyer.
(3) Incorrect Delivery Address and Default of Acceptance: If the customer provides an incorrect delivery address during the ordering process, unfortunately, we cannot assume liability if there is a default of acceptance due to this incorrect information. We would like to advise our customers to pay particular attention during the order to ensure that the address details are correct and all necessary information is entered completely in the designated fields.
(4) Delivery Difficulties and Replacement Shipment: In the case of delivery difficulties on the part of the shipping service provider where no progress is visible in the tracking system, we are willing to initiate a new shipment. However, this will only happen at the earliest if no updates have been recorded in the tracking system for at least 21 days. In such a case, the customer is obligated to notify us after the expiration of this period so that we can take measures for a replacement shipment. If a replacement shipment is sent to the customer, they commit to returning the goods from the first delivery attempt if they should still reach them.
§5 Retention of Title
We reserve ownership of the goods until the complete payment of the purchase price.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You can use the attached sample withdrawal form, which, however, is not required.
Withdrawal in case of delivery delay: If a customer wants to withdraw an order before the goods are delivered, this is only possible from the point at which no updates have been recorded in the shipment tracking for at least 21 days. In this case, the customer undertakes to return the goods to us if they should still reach him.
If there is a contract withdrawal due to a default of acceptance by the customer because they ordered the goods to an incorrect delivery address, we can only process the withdrawal if the customer can ensure that the watch is returned to us, and this actually occurs.
Consequences of Withdrawal
If you withdraw from this contract, we must repay you all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You bear the direct costs of returning the goods.
Consumers have no right of withdrawal for contracts regarding:
Goods that are manufactured according to customer specifications or clearly tailored to personal needs. Watches with personal engraving cannot be returned. The warranty and guarantee remain unaffected by this.
